Rooted Growth Commerce

By purchasing any service or product from Rooted Growth Commerce ("we," "us," or "our") through rootedgrowthcommerce.com, you ("you" or "Client") agree to the following terms.

1. Services Offered

Rooted Growth Commerce provides ecommerce consulting services including marketplace audits, listing optimization, catalog data enrichment, ongoing management retainers, account suspension support, and related advisory services. Service descriptions and pricing are listed on our website and may be updated at any time.

2. Orders and Payment

All purchases are made through our Shopify-powered website. Payment is collected at the time of purchase via the payment methods available at checkout. Prices are listed in US dollars. We reserve the right to change pricing at any time, but price changes will not affect orders already placed.

3. Delivery

Unless otherwise stated, all deliverables are digital, including audit reports, written recommendations, action plans, and video or phone consultations. Estimated delivery timelines are listed on each product page and depend on scope and catalog size. We confirm your specific timeline after purchase.

4. Refund and Cancellation Policy

You may request a full refund at any time before work has begun on your engagement. Once audit work, analysis, or consulting has started, no refunds will be issued. Digital deliverables (audit reports, written recommendations, action plans) are non-refundable once delivered.

If we miss the delivery timeline confirmed for your engagement and we have not mutually agreed to an extension, you are entitled to a full refund.

If you believe a deliverable was not completed as described, contact us within 14 days of delivery and we will work with you to resolve the issue. Factual errors in a deliverable are corrected at no cost.

5. Right to Decline or Discontinue Service

We evaluate fit for every engagement and may decline or discontinue any engagement at our sole discretion. This includes, without limitation: businesses that appear to operate in violation of applicable law or marketplace policies; engagements that would create a conflict of interest with an existing client; and situations where information provided to us materially misrepresents the client's identity, business, or purpose. If we decline or discontinue an engagement, all fees for work not yet performed are refunded in full.

6. Scope of Work

Each service has a defined scope as described on the product page at the time of purchase. Work beyond the stated scope (additional channels, additional listings, extended support) may require a separate engagement or additional fees, which will be discussed and agreed upon before any additional work begins.

7. Client Responsibilities

To complete your audit or engagement, you may need to provide access to seller accounts, analytics platforms, product data, or other business information. Timely access to these materials ensures we can deliver within the estimated timeline. Delays in providing access may extend the delivery timeline, and timeline commitments are measured from the date we receive the access required to begin.

You agree that the information you provide about your business, your identity, and the purpose of your engagement is accurate. We will never share your login credentials or business data with third parties.

8. Intellectual Property

Upon full payment, you own the deliverables we create for you, including audit reports, action plans, listing copy, and recommendations. We retain the right to use anonymized, non-identifiable data and general insights from our work for internal training, marketing case studies, and content creation. We will never use your brand name, store name, or identifiable business details without your written permission.

9. Confidentiality

We treat all client business information as confidential. We will not disclose your account data, financial information, business strategies, or audit findings to any third party. We do not disclose client names or engagement details publicly; case studies and published examples are anonymized. This obligation survives the end of our engagement.

We ask the same discretion of clients regarding unpublished methods, pricing conversations, and materials we share during an engagement.

10. Limitation of Liability

Our services are advisory in nature. We provide recommendations based on our experience and analysis, but we do not guarantee specific results, revenue increases, ranking improvements, or account reinstatements. Ecommerce platforms (Amazon, eBay, Walmart, Shopify, Faire, etc.) control their own algorithms, policies, and enforcement actions, and outcomes may vary.

Our total liability for any claim arising from our services is limited to the amount you paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.

11. No Professional Advice

Our services constitute ecommerce consulting only. Nothing we provide should be interpreted as legal, tax, financial, or accounting advice. For matters involving legal compliance, tax obligations, or financial decisions, consult a qualified professional in the relevant field.

12. Account Suspension Services

For account reinstatement and appeal services, we draft Plans of Action and submit appeals on your behalf based on our experience and understanding of platform policies. We cannot guarantee reinstatement, as the final decision rests with the platform. Suspension services are priced separately and scoped on a case-by-case basis.

13. Website Use

You may browse and use our website for its intended purpose. You agree not to misuse the site, attempt to access restricted areas, or use automated tools to scrape content. All website content, including text, design, and code, is the property of Rooted Growth Commerce and protected by copyright.

14. Privacy

Your use of our website and services is also governed by our Privacy Policy, available at rootedgrowthcommerce.com/policies/privacy-policy.

15. Changes to These Terms

We may update these Terms of Service from time to time. Changes take effect when posted on this page. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
